These apply to Customers and Venue Owners. By using the Platform, you agree to all terms contained herein.

Introduction
Terms & Conditions
2.1 Overview
These Terms govern your use of the Platform operated by EASPECT CONSULTING LIMITED.
2.2 Regulatory Context
Venue Owners are solely responsible for compliance with UK laws including Licensing Act 2003, Food Safety Act 1990, Health and Safety at Work etc. Act 1974, Equality Act 2010, Fire Safety Order 2005, Data Protection Act 2018 & UK GDPR, local licensing, and insurance requirements.
2.3 Platform Role
PlanMyParty acts solely as an intermediary. We do not own or operate venues, guarantee accuracy, enter contracts on behalf of users, or accept responsibility for user conduct.
2.4 User Obligations
Customers must provide accurate information, use the Platform lawfully, communicate respectfully, and honour bookings. Venue Owners must provide accurate information, maintain compliance, respond promptly, and ensure lawful content.
2.5 Indemnity
Venue Owners indemnify us against regulatory breaches, licensing violations, safety failures, food safety incidents, fire safety non-compliance, customer injury, data breaches, and IP infringement. Customers indemnify us against fraudulent use and venue damage.
2.6 Limitation of Liability
We exclude all implied warranties. We are not liable for indirect or consequential losses. Our total liability is capped at GBP 100.
2.7 Termination
We may suspend or terminate accounts for breach. Users may request deletion at any time.
2.8 Governing Law
These Terms are governed by the laws of England and Wales.
2.9 Dispute Resolution
Parties must attempt good-faith negotiation for 30 days, then mediation, then courts of England and Wales. Customer-Venue disputes are strictly between those parties.
2.10 Force Majeure
Neither party is liable for delays caused by events beyond reasonable control. If lasting more than 60 days, either party may terminate without liability.
Venue Participation Agreement
3.1 Compliance Obligations
Venue Owners warrant compliance with all UK licensing, safety, food hygiene, fire safety, equality, and insurance laws.
3.2 Data Handling Responsibilities
Venue Owners become independent data controllers upon receiving customer data and must comply with UK GDPR.
3.3 Prohibited Conduct
Venue Owners must not misrepresent venue details, upload unlawful content, or share customer data improperly.
3.4 Termination
We may remove listings for non-compliance or breach.
Privacy Policy
4.1 Data Controller
EASPECT CONSULTING LIMITED is the Data Controller for all data processed through the Platform.
4.2 Data We Collect
We collect data from Customers, Venue Owners, and automated systems.
4.3 How We Use Data
We use data to facilitate venue searches, connect customers with venues, improve the Platform, ensure security, and comply with legal obligations.
4.4 Sharing Data
We share data with venues, customers, service providers, and legal authorities.
4.5 Data Controller vs Processor Roles
We act as Data Controller for platform data. Venue Owners act as independent Data Controllers for customer data they receive. We act as Data Processor only in limited scenarios. No joint controller relationship exists.
4.6 International Transfers
Where data is transferred outside the UK, we apply IDTAs, SCCs, adequacy decisions, and safeguards.
4.7 Data Retention
- Bookings: up to 6 years
- Accounts: until deletion
- Analytics: 12-36 months
4.8 User Rights
Users may request access, rectification, erasure, restriction, objection, portability, and withdrawal of consent.
4.9 Marketing Consent & Opt-Out
Marketing requires explicit consent. Users may opt out via unsubscribe links, account settings, or email. Essential service communications remain unaffected.
4.10 Data Breach Notification
We notify the ICO within 72 hours where required and notify affected individuals where high risk exists. Venue Owners must notify us of breaches affecting customer data.
4.11 Processing by UK/EU/International Teams
Authorised development, maintenance, support, and marketing teams may access data from the UK, EU/EEA, or outside the EU. All processing is safeguarded and limited to operational necessity.
Advertising
6.1 Third-Party Advertising
We may display advertising on parts of the Platform. Where we do, advertisements are served by third-party advertising partners rather than by us.
6.2 Google AdSense
We use Google AdSense to serve advertising. In connection with this:
- Third-party vendors, including Google, use cookies to serve advertisements based on your prior visits to this or other websites.
- Google's use of advertising cookies enables it and its partners to serve advertisements to you based on your visit to this Platform and other sites on the internet.
- You may opt out of personalised advertising by visiting Google Ad Settings.
- You may opt out of the use of cookies for personalised advertising by some third-party vendors at aboutads.info or Your Online Choices.

6.3 Consent for Advertising Cookies
If you are in the United Kingdom, the European Economic Area or Switzerland, advertising cookies are only set where you have given consent through the consent dialog described in Section 5.4. Where you decline, advertising may still be shown but will not be personalised using cookies. You may change or withdraw your choice at any time using the Cookie settings link in the footer.
6.4 What We Do Not Do
We do not sell your personal data to advertisers. We do not knowingly serve personalised advertising to children. We do not share the details of your venue enquiries or bookings with advertising partners.
6.5 Distinguishing Advertising from Content
Advertisements are labelled and visually distinct from our own editorial content. Our guides and venue information are written independently, and advertisers have no influence over them.
